Frequently asked questions

How long does it take to set up the LLP?

The formation of an LLP can take place within a few days. However, it usually takes a few weeks as all members are required to sign the incorporation forms and provide a number of documents. Commissioning a contract of work will naturally take a longer period of time, and this will be discussed with you when agreeing your business plan.

We will meet with all the interested members and discuss the setup process and go through the legal paperwork and documents. We will agree a marketing and business plan with you and start work straight away on your behalf. We ensure that all members are fully aware of the contents of our very comprehensive LLP Members’ Agreement to avoid any ambiguities or issues that may arise later down the line.

No, we can never guarantee to commission an LLP work. When forming a business, success is never guaranteed. However, we will only suggest forming an LLP if there is a genuine need for your business in your local area, and we believe it will be a success. A successfully working LLP depends on a number of factors including ensuring there is a local need, reasonable fee proposals from the LLP, an open dialogue with management (usually through Trust Health), having an identified lead consultant within the LLP and a core number of LLP members.

Our nationally accepted model permits the LLP consultants to take responsibility for staffing of the theatre episode of a patient journey. All staff engaged in the theatre, including recovery, are engaged on a pay-per-procedure basis. Consultants and staff are paid a rate for each procedure that takes place, rather than on a sessional or hourly basis. It provides an efficient and cost-effective delivery model, whereby efficiency improvements of up to 30% can be seen. Trust Health takes control of all operational logistics, such as organisation of staffing for the lists, coding of procedures, invoicing and payment to all staff members, and resolution of challenges, allowing LLP consultants to focus on patients rather than administration.

Only two members are required to form an LLP, but we would suggest four members as ideal, with the maximum number immaterial provided there is strong leadership within the LLP. If there are a large number of members, we would suggest having a “lead” for each specialty, for example, in orthopaedics, we would suggest an upper limb lead, a lower limb lead, a spinal lead, etc.

A shortage of beds is a common issue in hospitals, and the question is frequently asked how the LLP can provide additional work under these conditions. In this situation, we would suggest the LLP undertakes day case work only. One of the advantages of the LLP model is the flexibility provided to the hospital, and we would work with the hospital to identify alternative ways in which the LLP can assist.

It is unlikely you will have issues with recruitment. In our experience, staff are extremely keen to undertake additional work for the LLP. We ensure that the payment rates are attractive for them and that the contracts and PAYE arrangements are taken care of, ensuring a simple process for staff.

Yes, we can provide you with typical fees that consultants earn across the UK. The exact fees agreed with a Trust will be dependent on a number of factors including NHS tariff, volumes and case mix. Ultimately, the fees we propose to a Trust will be your decision, but we will recommend fees that we know from experience are acceptable to Trusts.
